1. ACCEPTANCE OF TERMS

By accessing or using The Monnaco Collection website and services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use our services.

 
2. DESCRIPTION OF SERVICE

The Monnaco Collection provides access to curated visual content including photography, illustrations, videos, and design resources through paid membership subscriptions (Curator, Studio, and Agency tiers).

 
3. MEMBERSHIP AND BILLING

Subscription Plans: We offer monthly and annual subscription plans for each membership tier. You will be charged on the same date each month or year as your original purchase date.

Free Trial: New members receive a 7-day free trial period. You may cancel anytime during the trial period at no charge. If you do not cancel within 7 days, your subscription will automatically begin and you will be charged.

Founding Member Pricing: Founding members who join during our launch phase receive exclusive pricing locked in for the lifetime of their continuous membership.

Pricing: Your subscription price is locked in from your date of purchase and will not increase during your continuous subscription period.

Auto-Renewal: All subscriptions automatically renew unless cancelled. You may cancel anytime through your account settings.

Payment: You authorize us to charge your selected payment method. You are responsible for maintaining current and valid payment information.

 
4. ACCEPTABLE USE

Permitted Uses: You may use our content in accordance with your membership tier and our separate License Agreement.

Prohibited Uses: You may NOT:

  • Use content to promote hate speech, discrimination, harassment, or other harmful or malicious purposes
  • Use content to defame, slander, or harm individuals or groups
  • Resell, redistribute, or sublicense our content as standalone products
  • Share your login credentials with others
  • Circumvent access restrictions or security measures
  • Use content for illegal purposes
  • Claim ownership or authorship of our content
 
5. INTELLECTUAL PROPERTY RIGHTS

Ownership: All content, including but not limited to photographs, illustrations, videos, text, graphics, logos, and software, is owned by The Monnaco Collection or our licensors and is protected by United States and international copyright laws.

Your License: Your rights to use our content are governed by our License Agreement, which varies by membership tier.

Trademark Protection: “The Monnaco Collection” and our logos are trademarks. You may not use our trademarks without written permission.

DMCA Compliance: We respond to valid DMCA takedown notices. For copyright concerns, contact us at ana@monnaco.com.

User Content: Any content you upload or submit to our site becomes our property and may be used by us without restriction.

 
6. ACCOUNT TERMINATION

We may suspend or terminate your account immediately for violations of these Terms, including but not limited to prohibited content usage or payment failures. Upon termination, your access ends immediately, but these Terms remain in effect regarding prior usage.

 
7. LIMITATION OF LIABILITY

To the fullest extent permitted by Tennessee law, The Monnaco Collection’s total liability to you shall not exceed the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages. Some states do not allow limitation of certain damages, so these limitations may not apply to you.

 
8. DISCLAIMERS

Our services are provided “as is” without warranties of any kind. We do not guarantee uninterrupted access, error-free operation, or that our content will meet your specific needs.

 
9. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless The Monnaco Collection from any claims arising from your use of our services or violation of these Terms.

 
10. MODIFICATIONS

We may update these Terms at any time. Material changes will be posted on our website with at least 30 days’ notice. Continued use after changes constitutes acceptance.

 
11. GOVERNING LAW

These Terms are governed by Tennessee state law without regard to conflict of law principles. Any disputes will be resolved in Tennessee courts.

 
12. SEVERABILITY
